DUI checkpoints scheduled for Cinco de Mayo

Posted on Wednesday, May 2nd, 2012 at 9:07 am

For the first time in five years, Cinco de Mayo falls on a weekend. This means that police departments across the country are adding numerous DUI checkpoints in various cities in order to decrease the amount of drunk driving accidents.

This holiday is largely associated with celebrations and heavy drinking. The National Highway Traffic Safety Administration revealed that 30 percent of fatal accidents that happen over the weekend are caused by drunk drivers. These checkpoints will also be seen largely at night, due to the fact that the fatality rate for drunk driving accidents is four times higher during that time.

In the states where DUI checkpoints are allowed, they have to meet specific criteria in order to be legal. These criteria can include announced plans of the checkpoints as well as a limited length of time for the checkpoints.

Cellphone use while driving equivalent to legal alcohol limit

Posted on Wednesday, April 18th, 2012 at 10:18 am

According to the University of Utah, an individual who is operating a cellphone while driving is considered to have the same amount of delayed responses as an individual who has a blood alcohol limit of 0.08 percent, the legal limit.

Distracted driving is the topic of discussion for the month of April, and the U.S. Department of Transportation is calling this month the National Distracted Driving Awareness month. Delayed driver’s reaction times can be extremely dangerous, and could lead to disastrous car accidents and injuries.

Teen drivers have been found to be involved in fatal distracted driving accidents at a higher rate than other drivers. In 2009, 16 percent of deadly car accidents involving teenagers also included some form of distracted driving.

It is important to be safe on the roadways in order to avoid life-altering collisions. If you have been accused of driving under the influence of alcohol, please contact the Arizona DUI defense lawyers of Thompson & Volquardsen, P.C. by calling 602-510-9999 today.

State of Arizona thinking about reinstating jury trials for DUI cases

Posted on Monday, February 20th, 2012 at 7:10 pm

A bill that went into effect in December 2011 changed the way that DUI offenders had their cases heard in court. According to the new bill, only repeat extreme DUI offenders would have the privilege of a jury trial, even though first time offenders could possibly spend six months in jail if convicted of their charge.

The House Judiciary Committee of the state believe that the wording should be changed in this bill in order to include first time offenders as well. They believe that all persons accused of driving under the influence in the state of Arizona have the right to a trial by jury.

The House Bill that is being proposed would eliminate the wording regarding former DUI convictions, and would open the jury option to all offenders. The bill needs to be passed by the House as well as the Senate before being approved by the Arizona governor.
