Arizona Penalties for OUI

Under Arizona law, boating while intoxicated is known as “operating under the influence” or OUI. Much like driving under the influence, this offense is taken very seriously. OUI Legal Consequences

If you are convicted of OUI, your sentence will likely depend on a number of factors. These include your blood alcohol content (BAC) at the time of your arrest, and whether or not you have been convicted of OUI in the past. Your age may also be a factor, as it is illegal to consume any amount of alcohol if you are under the age of 21.

For a first-time offense with a BAC of .08 to .15, the penalties for OUI may include:

  • Up to 6 months in jail, and/or a mandatory alcohol education class
  • A fine of up to $2,100

For a first-time offense with a BAC over .15, the penalties may include:

  • A minimum of 30 days in jail
  • Fines up to $2,500

For every subsequent offense, the fines will increase. In addition, you may not have the option of alcohol education in lieu of jail time for a second or third offense. You may also be facing longer prison sentences.
