#1: You Have to Be Driving to Be Arrested

In fact, the law states that a person needs to be in physical control of a vehicle to be arrested. This does not mean that the arrested individual actually must be driving. Instead, they can simply be in the vehicle and have the physical ability to operate it. In some cases, drivers have even been arrested for sleeping in a vehicle.

#2: You Have to Submit to a Breathalyzer Test

In the state of Arizona, the law does not force you to take a breathalyzer test. Although there may be certain complications you have to deal with if you do not submit to a breathalyzer, you do not have to submit to this test when asked. However, if you refuse, police may present a case for a warrant. They can obtain a blood test if they can secure this warrant.

#3: DUI Arrests Can Be Easily Erased

Expungement is available for many small crimes, but this is not available for DUI in the state of Arizona if an individual is convicted. Once convicted, a DUI will permanently stay on a person’s criminal record.
