DUI and Means of Transportation

DUI is the acronym for a criminal charge of Driving Under the Influence. However, there is not a very clear definition of what constitutes a vehicle that may be driven, and therefore which may not be operated while an individual is intoxicated. Instead, police may use a definition of intoxicated operation of a vehicle to widely include other forms of transportation. This can result in a person being arrested for DUI charges although they are not behind the wheel of an automobile.

Unorthodox DUI Charges

DUI charges are not necessarily well-defined when it comes to what vehicles can be considered for DUI arrests. Instead, police will often arrest anyone intoxicated and operating a vehicle. However, even the definition of a vehicle can be somewhat wider than expected in some cases. The following may be considered a vehicle for the sake of DUI arrests:

  • Horses and donkeys
  • Four-wheelers
  • Personal watercraft and other boats
  • Wagons and buggies
  • Tractors
  • Motorized wheelchairs
  • Bicycles

These methods of transportation can be cited as a vehicle in a DUI arrest, although a person may fight these charges on the basis that these modes of transportation may not warrant DUI penalties.
