A person facing Arizona DUI charges or a conviction may be able to have their criminal record modified in some situations. Two ways in which a person can try and do this is to file for an expunction or receive a pardon. However, these options are not available in all cases. Additionally, an expunction is not permitted for a DUI conviction in the state of Arizona.

Differences between Expunctions and Pardons
Both expunction and pardoning can change how a person is treated in the criminal justice system. However, these two methods vary sharply in their purpose and execution. The following differences occur between expunctions and pardons:
- You can file for an expunction after all penalties are served
- A pardon is granted either after or while penalties are being served
- An expunction clears a criminal record of a charge
- A pardon does not clear a record, but allows a person freedom
- An expunction is not available for DUI in Arizona
- A pardon is available in Arizona, but can be difficult to secure
While expunctions are not allowed for DUI charges, there may be opportunities for a convicted motorist to pursue expunction for related crimes that are not under the same expunction restrictions as DUI charges.
