The Basis of the Miranda Rights

The Miranda warning became part of American jurisprudence based upon the decision given by the United States Supreme Court in Miranda v. Arizona. The ruling was rooted in the conflict between a suspect’s ignorance of his 5th Amendment right to avoid making self-incriminating statements and the information that police had been able to obtain due to Miranda’s lack of awareness about this protection. In order to prevent the violation of the United States Constitution, the Supreme Court asserted that suspects must be informed about their 5th Amendment rights and the 6th Amendment right to legal counsel before any interrogation can yield information that can be used against them.
