Each branch of the US Armed Forces deals with DUI hearings and convictions differently. However, each branch provides an additional hearing for their service members to supplement the usual criminal trial. These hearings are known as a captain’s mast in the Navy. Unlike criminal hearings, these are not considered trials and do not hold the same formal features as a criminal trial. Non-judicial Hearings for the Navy
The United States Navy uses the captain’s mast as a non-judicial hearing for their service members. While this does not mean that a person enjoys the same rights and privileges as they might as a defendant in a criminal trial, the hearings do afford some level of legal protection.
These hearings generally include the following steps:
- The officer overseeing the hearing learns about the charges and details
- The accused service member can present their arguments
- The officer overseeing the hearing decides on the guilt of the service member
- If guilty, the service member learns about their punishments
In particularly serious cases, a service member can be dishonorably discharged as a result of a DUI conviction.
