Understanding Federal DWI

Most people are only aware of state DUI/DWI charges, or drunk driving charges that are prosecuted by the state government. While state DUI makes up the majority of drunk driving cases, there are some instances in which individuals can be charged with driving under the influence by the federal government. This is called a federal DWI.

A federal DWI can result in even harsher consequences than an Arizona DUI. However, individuals still have the right to defend themselves against these charges. What is Federal DUI?

The federal government owns land and buildings throughout many different states. In some cases, if you are found to be driving while intoxicated on this federally owned land, you can be charged with a federal DUI. However, most federal lands defer to the state government, with the exception of national parks. If you commit DUI while in a national park, you can face consequences such as:

  • Class B misdemeanor
  • Fine up to $5,000
  • Up to six months in a federal prison
  • Five years of probation
  • Assimilative Crimes Act

If you are found to be driving while intoxicated on federal land, it may fall under the Assimilative Crimes Act. This legislation gives state governments the right to prosecute drunk driving charges as they normally would, even if the infraction occurred on federally owned land. However, defendants may face additional prison time under certain circumstances, including 5 more years in jail if a minor was harmed in a drunk driving accident.
