    Charges and Penalties

    Typically, a Federal DUI is prosecuted as a Class B misdemeanor, but the charge may be elevated if you were well above the legal BAC limit, were driving recklessly, had a child under the age of 14 in the vehicle with you while driving under the influence, or have multiple DUI convictions in your criminal history. If you are convicted of Federal DUI as a Class B misdemeanor, you may be penalized with up to 6 months of imprisonment in a federal penitentiary, up to $5,000 in fines, up to 5 years of probation, or a combination of these.
