Federally Owned Land and DUI
Any arrest that is made on federally owned land is prosecuted in a federal court. There are many different types of federally-owned land on which a drunk driver may be arrested for a Federal DUI, such as:
- National Parks
- National Monuments
- Military bases
- Courthouse property
- Airport property
- Government building lots and driveways
If you have been arrested for drunk driving on any of these types of federal land, it is important to know that you may be facing a Federal DUI charge, not a state one.
Charges and Penalties
Typically, a Federal DUI is prosecuted as a Class B misdemeanor, but the charge may be elevated if you were well above the legal BAC limit, were driving recklessly, had a child under the age of 14 in the vehicle with you while driving under the influence, or have multiple DUI convictions in your criminal history. If you are convicted of Federal DUI as a Class B misdemeanor, you may be penalized with up to 6 months of imprisonment in a federal penitentiary, up to $5,000 in fines, up to 5 years of probation, or a combination of these.
